Same-sex Divorce

By Jeff Adolph

LGBT Legalities

Lynch_and_chambersThe first same-sex divorce case heard on the 9th of October 2007 in the Rhode Island Supreme Court has made history and headline news nationwide.

Cassandra Ormiston, a retired Realtor and Margaret Chambers, a painter are a Rhode Island couple who elected to marry in Massachusetts and now seek a divorce.

Media filled the court as did spectators; all were interested in how the proceedings would unfold.

ImagesThe dilemma of course, is that Rhode Island does not recognize same-sex marriage and therefore cannot grant a divorce; a factor that the lesbian's lawyers were trying to have over-turned.

As Omiston said, 'I never in my wildest dreams thought that it would be possible for me to marry, and so I was thrilled to have the opportunity. Obviously, I am not thrilled to be the first divorce case, but it is my right, as it is everyone's right.'

To-date, it is estimated that over 200 same-sex couples from Rhode Island have also wed in Massachusetts and it is hoped that these unions will be more successful than that of Ormiston and Chambers who will be forever inscribed in the law books as the first same-sex couple in Rhode Island to seek divorce.

If the case is unsuccessful the couple would have to move to Massachusetts and live there long enough to qualify for a divorce, an issue that both do not want to have to face.

Thanksgiving, Belcourt Castle and the Tinney that Never was!

By Jeff Adolph

Historical Estates

Ria0010bgThe battle that began in 1997, the day before Thanksgiving, has finally concluded. Harle Tinney can now look toward a peaceful future in her beloved Belcourt Castle, after Justice Michael Egan ruled in her favor of full ownership of the property, forcing Kevin Tinney who was adopted at the age of 37, by Harle's late mother-in-law, out.

The 60-roomed castle is worth over $6 million without even considering the antiques and furniture that lines its walls; collected from over 33 countries within the homes life-time it is considered priceless.

Undoubtedly, this is why Kevin Koellisch, handyman and estate plumber began courting Ruth Tinney in the late 80's after her husband passed. Something Harle and others were immediately suspicious of, especially when Kevin was openly gay, and Ruth was in her 80's.

As Keith B. Kyle, Harle's attorney stated of Kevin's affair, 'he started courting her (Ruth) even though he lived with another man. I think he's pretty openly gay. He was almost secreting her from the rest of the family... He prevailed on her to adopt him.'

Harle added, 'in the summer of 1991 when he (Kevin) asked her (Ruth) to marry him, I said "you are not going, to get married." So she said she'd adopt him.'

Belcourt_castle_2Now with this chapter of her life closed, Harle is looking toward pursuing her late husband's dream of preserving Belcourt Castle and its collections as a museum.

Harle is working with architect Richard Long to restore the castle and preserve its heritage.

As Harle said, 'if I were to die tomorrow, I would like Belcourt Castle to be able to survive into the future as a way that is useful as a museum for educational purposes in its broadest sense. That was Donald's dream.'

It is estimated that approximately $10 million is needed to do the necessary repairs and maintenance on the property before anything else is done. Though what price can really be put on a castle built in 1891-1894 for $3 million by architect Richard Morris Hunt, who passed in 1895?

Rhode Island Walsh A Doer, Not Just A Thinker

Politics

Ib1764Donna M. Walsh who is running for the Rhode Island House of Representatives has big visions for the future...

Apart from co-sponsoring legislation that saw a substantial increase in the Rhode Island Housing and Conservative Trust Fund, by raising the real estate transfer tax on homes that sold above the median price. Walsh has also helped introduce background checks into camp ground and daycare workers and insists safety and environmental factors are amongst the keys to success.

As Walsh states, 'I bring 38 years of community experience in our towns. I bring leadership skills, and the desire to do as much as I did when I was a senator, if not more.'

The 63-year old former state senator teaches sixth grade at Chariho Middle School and serves as vice president of the Charlestown's district council.

Walsh plans to sponsor legislation that will phase out Cesspools, if elected, in order to protect the environment.

Rhode_isAs Walsh adds, 'the coastal, untouched areas of our state are inhabited by people that want to keep it that way and I share in this vision.'

Walsh is endorsed by a plethora of initiatives including OutPAC, a gay, lesbian, bisexual and transgender action committee, as she is about the people, community life, equality and freedom of speech for all. And, Walsh feels that now is the time that the Rhode Island community has a spokes woman who is a doer and not just a thinker.

Indepedence Day and RealEstate in Bristol

By Jeff Adolph

Good Investments

Pi20050115c01Today all Americans share an affiliation that spans across the centuries, the day when our ancestors gained Independence from the British. Parades, concerts, band performances, pageants and balls will unfold across the nation commemorating a day where all Americans are proud of their heritage; celebrations that signify an uprising against repression, rebellion, and an expression of our rights, a day when all communities nation wide will join in celebration, putting differences aside.

On the 4th. of July in 1777, thirteen cannons fired across the Narragansett Bay, marking the Declaration of Independence, at as the sun set across that rippling water thirteen gun shots rung out, one for each of the colonies.

Yet, war still raged across America and one such place that continued the fight was Bristol, Rhode Island, with red coats burning the coastal town founded almost a century earlier.

Today, Bristolians enjoy commemorative services that begin in June of every year, with the patriotic colors painted on the highway marking not only the parade route but also the need for preparation by the residents.

Garden's are manicured with lawns mowed, hedges trimmed and bed's manicured, flags are unfurled, and baking begins for the annual family gatherings and picnics.

Several years ago the chancellor of Roger Williams University, situated in the Region stated, 'Patriotism moves ordinary men and women to extraordinary accomplishment, gives courage to the meek, and strength to the weak...'

With onlookers saying they have been coming to this parade since they were babies, a family tradition they have carried on as they too now nurse their little-uns, wide-eyed with anticipation through the celebration.

One spectator, his first time at the parade said, 'we drove 100 miles and you know what the people are just as much fun...'

BristolThe celebrations will see thousands flock to the coastal town with the population of  25,000 swelling to capacity, which at times is a staggering 250,000. On many occasions those from out of town will arrive in the early hours of the morning on Independence day to claim a premium position along the two and half mile parade route of Hope and High Streets. The house lined streets that are said to be Real Estate draw-cards with the same magnitude that 'River View' has for Manhattan apartments. The median house price in Bristol has jumped from $157,000 US in the year 2000 to $575,000 US in 2005, an estimated 366% rise in property value.

Bristol on the 4th. of July is not only Rhode Island's home town but also America's, as the celebrations end at dusk with fireworks over the harbor, like those thirteen  shots fired centuries earlier, only more spectacular.
